THE REPUBLIC vs. KWAME NSIAH
RULING This ruling is in respect of a submission of no case filed by counsel for the accused person herein. The accused person herein, Kwame Nsiah was charged with the offence of murder contrary to section 46 of the Criminal Offences Act, 1960 (Act 29) and arraigned before this court on a bill of indictment. The brief facts of the case as presented by the prosecution are that the accused person, Kwame Nsiah and the deceased, Asante Nkae used to live together in concubinage for about 28 years and had three (3) children together. The accused and the deceased at some point in their relationship had misunderstandings which ended up at the Asankrangwa Social Welfare. The authorities there, in an attempt to amicably resolve the issues between the accused and the deceased requested the accused to hand over part of their cocoa farm and their 2-bedroom house to the deceased which he obliged. On 17th May, 2016 the accused asked their daughter Amoawah to fetch water for him which she did. ...
