WILLIAM MINNAH vs. THE REPUBLIC

JUDGMENT This is an appeal against the decision of the Circuit Court, Tarkwa dated 19th August, 2020. Appellant herein was arraigned before the Circuit Court Tarkwa, on a charge of stealing contrary to section 124(1) of the Criminal and Other Offences Act, 1960 (Act 29). The facts as presented by the prosecution were that the complainant is a businessman and he is the owner and MD of a hardware store known as DAN TO BE Enterprise at KWABEDU, a suburb of Tarkwa. Prosecution says that in the year 2010, the complainant employed the accused person (Appellant herein), aged 52 years as manager of the store and gave him a free bungalow accommodation to live in. According to the prosecution, the accused was advised not to give out goods on credit. In early 2015, the complainant detected some abnormality in the business; he found out that the income level has gone down drastically whilst the quantity of wares in stock has also reduced.
