THE REPUBLIC vs. KOFI ASEIDU @ ADUSEI, JOHN KWASI YANKSON @ CYBORG & 4ORS.

JUDGMENT This judgment is in respect of an appeal against the judgment of the Circuit Court, Sekondi dated 13th March, 2023. The Appellant and others were charged with the offences of conspiracy to commit crime to wit: robbery contrary to sections 23(1) and 149 of the Criminal Offences Act of 1960 (Act 29) and robbery contrary to section 149 of Act 29. The facts culminating in this case as narrated in the words of the prosecution and recorded at pages 2 and 3 of the record of appeal (ROA) are that; Complainants Michael Wiafe and Isaac Awortwe are manager and Chief Executive Officer [CEO] of Transroyal Cocoa Buying Company and Mama Esther Cold Store respectively. Both are located at Petepom-Beposo whilst accused persons are professional drivers staying in Takoradi.
