RULING On 13th May, 2023 during the application for directions stage, the court gave the following orders: “I have perused all the issues filed by the parties. I have also looked at the pleadings including the amended statement of defence. I have observed that prominent among the issues are: Whether the Plaintiff has capacity to initiate the instant action and whether the instant action is a cause or matter affecting chieftaincy. These issues can be determined as preliminary points of law. Consequently, the court hereby set the above issues down as preliminary points of law. Counsel are ordered to file their written submissions relating to these issues within 21 days. They are to do so simultaneously.” Plaintiff is aggrieved by the order of the court and has filed a motion on notice to set aside the aforesaid order of the court.
