JUDGMENT DR. POKU ADUSEI, J.A. At his arraignment at the Circuit Court, Abuakwa, Kumasi the Appellant herein, Owusu Bempah, was charged with four counts of offences involving a Motorbike, namely: COUNT ONE Statement of Offence Careless and inconsiderate cycling contrary to Section 31 of the Road Traffic Act 761/2008 Particulars of Offence Owusu Bempah, aged 30. Rider: For that you on the 21st Day of June 2024 at about 5pm at Atwima Sepaase in the Ashanti Circuit and within the jurisdiction of this Court, then being the rider in charge of unregistered Apsonic motorbike did ride the said motorbike on the road without due care and attention to other road users. COUNT TWO Statement of Offence Negligently causing harm contrary to Section 72 of Act 29/60 unlawful damage: contrary to section 172 of the Criminal Offences Act 29/60 Particulars of Offence Owusu Bempah, aged 30.
