JUDGMENT 1. INTRODUCTION [i] This is quite a simple matter. The Applicants herein contend they are the occupants of a number of flats situate at Tema Community 2, known as Italian Flats; and the Respondent herein is the daughter of the previous owner or occupant of flat no. 205. 2. FACTS OF THE APPLICANTS’ CASE [ii] According to the Applicants, within the environs of the group of flats, there is a common area or some form of vacant compound lying within the main housing block and that area houses the septic tanks and underground sewage inspection chambers of all the blocks of flats known as Italian flats. That area also serves as a common compound for all the occupants of the Italian flats, particularly the occupants of block D. In spite of the area being a common compound and housing underground septic and sewage system of the flats, the Applicants contend that the Respondent herein has unlawfully appropriated that common area and commenced the construction of a cho.....
