TRUE COLOUR EVENTS vs. GLOBACOM LIMITED & GLO MOBILE GHANA LTD
The Plaintiff, a South African company, contracted with the 1st Defendant (Globacom Limited, Nigeria) to organize four events in Ghana to launch the 2nd Defendant (Glo Mobile Ghana Ltd). The Plaintiff received 80% payment ($3,520,000) and airlifted equipment to Ghana, which was held by the Defendants. Three events were cancelled by the Defendants, who then terminated the contract and refused to release the Plaintiff's equipment, alleging indebtedness. The Plaintiff sought replacement or payment for destroyed equipment and lost income due to detention of equipment.
read moreJUDGMENT By the instant action, the Plaintiff is seeking for the following reliefs against the Defendants: a) An order directed at the Defendants to replace the Plaintiff’s equipment which was destroyed whilst in custody of the Defendants OR Alternatively, an order directed at the Defendants to pay for the open market value of the equipment at the time of judgment by the Honourable Court. b) An order directed at the Defendants to pay for lost income and profit in the nature of accrued or lost revenues from February 2012 to date of final payment of the sum of Four Thousand Four Hundred United States of America Dollars ($4,400) per day from February 2012 to the date of final payment. c) Costs, including the costs of legal representation. d) Any other orders that this Honourable Court may deem fit.
