RULING A. SUMMARY OF FACTS 1. By a complaint filed at the Commission dated 6 April 2022, Dr Emil Yaw Opare (Complainant) says he was employed by Meridian Port Services Limited (Respondent) on 20 November 2006 as IT Manager. According to the Complainant, the Respondent failed or neglected to properly calculate the Complainant's end-of-service benefit. In a letter dated 16 July 2021, the Complainant requested the Respondent to re-calculate the Complainant's end­ of-service benefit. The Complainant's case is that the Respondent should have calculated the end-of-service package using the Meridian Dock Union (MDU) Collective Bargaining Agreement (CBA). 2. By a letter dated 1 September 2021 the Respondent in response to the 16 July 2021 letter of the Complainant stated that the calculation of the end-of-service benefit was in accordance with the terms of the Complainant's employment contract.
