GUO CHUANDE vs. MAXAM GHANA LIMITED
RULING Introduction The Complainant filed a case of unfair termination against his employer, Maxam Ghana Limited on 3rd November, 2022. Complainant's case: The Complainant was employed by Maxam International on 12th July, 2013 as a Technology Application Engineer. He was transferred to various Maxam sites in different countries with Ghana being the latest. In December 2020, he was assigned to Maxam Ghana Tarkwa site, based on an employment contract dated 3rd December, 2020, effective 1st January 2021, and he started work on 7th January 2021. In addition to the contract of employment there was a signed Memorandum of Understanding, which included his seniority transfer to Maxam Ghana and this transferred all his entitlements from Maxam International to Maxam Ghana before his contract and insurance in Maxam China was terminated.
