JUDGMENT DARKO ASARE, JSC: 1. My Lords, the appeal before us stems from a judgment of the Court of Appeal wherein the learned Justices of Appeal reversed the trial court’s decision to declare a purported re-entry by the 1st Defendant/Respondent as void and decreed title in the Plaintiff/Appellant. 2. The facts germane to this appeal have been adequately set out in the judgment of the Court of Appeal, and we would only highlight the salient points necessary for the determination of the issues raised in this appeal. 3. For purposes of convenience, the Parties in these proceedings, shall bear the same designation that they bore in the trial court and accordingly the Plaintiff/Appellant herein shall be described as Plaintiff, whilst the 1st Defendant/Respondent herein as 1st Defendant.
