JUDGMENT ASIEDU, JSC: [1] INTRODUCTION: My lords, on the 13th November, 2020, the High Court delivered a judgment and dismissed the reliefs sought by the Plaintiff against the Defendants therein. The 3rd, 4th and 5th Defendants were given judgment on their counterclaim against the Plaintiff, including a declaration of title to the disputed land in the 5th Defendant; an order for recovery of possession of the said land and an order directed at the Plaintiff to remove any structure constructed by the Plaintiff on the land in dispute. The Plaintiff was also perpetually restrained from dealing with or interfering with 5th Defendant’s land. Dissatisfied with the judgment of the High Court, the Plaintiff appealed to the Court of Appeal praying the Court of Appeal to set aside the judgment of the trial High Court.
