SLOATENG & COMPANY LTD vs. NATIONAL SPORTS AUTHORITY

The Plaintiff, Sloateng & Company Ltd, claimed lawful acquisition of House No. 156, Ringway Estate, Osu, Accra, via a deed of assignment from Top Heights Capital Management Ltd, which had a sublease from the State Housing Company (SHC). The Plaintiff alleged the property was vacant upon acquisition but found the Defendant, National Sports Authority (NSA), occupying and renovating it. The Defendant asserted continuous lawful possession since 1959/1960, having purchased the property from SHC's predecessor, the Ghana Amateur Sports Council, and maintained possession and payment of ground rent and utilities since then. The Defendant challenged the Plaintiff's title, claiming SHC lacked capacity to lease or assign the property in 2016/2018 due to prior valid interest held by the Defendant.
