Before this court is a motion on notice praying for an order to stay and/or suspend the two weeks’ jail sentence inflicted on the Appellant/Applicant [hereinafter called the applicant]. The sentence was imposed on the applicant by this court consequent upon his conviction for blatantly disobeying the prohibitory orders of this court dated 11/12/2024. The applicant has appealed against the said ruling of the court dated 28/02/2025 which convicted and sentenced him for contempt. As a sequel to the appeal, he has filed the instant application for stay and/or suspension of the sentence imposed on him by this court. The applicant’s contention is that his appeal against the conviction and sentence for contempt of court has a great chance of success. He has further averred that in the likely event that his appeal succeeds, same would be rendered nugatory since the two weeks’ custodial sentence inflicted on him would have long elapsed.
