JUDGMENT Dr. Poku Adusei, J.A. This is an appeal against the decision of the District Court Ejisu, Ashanti. The facts which gave rise to the instant appeal before this Court are as follows: the plaintiff/appellant [hereafter referred to as the appellant) instituted legal action against the defendants/respondents (hereafter referred to as the respondents) over a plot of land at Ejisu-Onwe. The appellant averred that the land in dispute was originally acquired by his late uncle: Opanin Kwame Kra. According to the appellant, the late Opanin Kwame Kra constructed a house on a part of the land, fenced the completed part and laid a foundation on the remaining portion of the land with intention to develop same later. The appellant asserted further that after the death of his uncle, a family member named Akosua Kobi succeeded him, and took control of the completed house as part of their family property.
