RULING Dr. Poku Adusei, J.A. This is a dispute between uterine siblings over the ownership of a house numbered as Plot 10 Block I, Abuakwa-Kumasi. The plaintiff/appellant [hereinafter referred to as the appellant) commenced legal action in the District Court, Asokwa-Kumasi for an order of ejectment and recovery of possession of three (3) rooms and a store-room in the disputed property from the defendants/respondents (hereinafter referred to as the respondents). The appellant’s claim was that he acquired the disputed plot on 8th December 1989 from the Gyase Pinanko Stool, Abuakwa-Kumasi and constructed a building on it. It is the case of the appellant that he subsequently procured a new allocation note for the disputed property from Nana Asuboffuor Kwaw II, Otumfuor Gyasehene/Buabasah, the overlord of the Gyase Pinanko Stool Lands, and applied for a certificate of land allocation from the Asantehene’s Land Secretariat.
