ATC TOWER (GHANA) LTD vs. PPL NET GHANA LIMITED
The Plaintiff, ATC Tower Ghana Ltd, owns and operates telecommunication masts and entered into a Master Tower Space Use Agreement with the Defendant's parent company, Airtel Ghana Ltd. The Defendant, PPL Net Ghana Limited, a wholly owned subsidiary of Airtel Ghana Ltd, allegedly operated telecommunication equipment on Plaintiff's sites without Plaintiff's consent following a transfer of business from the parent company to the Defendant. Plaintiff claims this conduct breaches the agreement, which prohibits assignment without consent, and constitutes trespass to its sites.
