JUDGMENT [1] The Plaintiff commenced the instant action against the Defendant on 28th July 2023. Per its Writ of Summons and Statement of Claim, the Plaintiff is seeking the following reliefs: a. A declaration that Defendant was negligent in its operations when it authorized the withdrawal of a total amount of GHS3,425,000.00 from Plaintiff's account. b. Refund of the sum of GHS3,425,000.00 to the Plaintiff, being the total amount of money Defendant negligently transferred out of the bank account of the Plaintiff to an unauthorized 3rd party. c. A declaration that Defendant breached the contract between Plaintiff and Defendant. d. An order of restitution to compel the Defendant to refund the said GHS3,425,000.00. e. Interest on the said GHS3,425,000.00 calculated at the commercial rate from 14th September 2021 until the date of final payment. f. Damages for breach of contract. g. Damages for negligence. h.
