The Plaintiff, Richard Alottey, purchased ten plots of land approximately 1.51 acres at Ablekuma, Accra, in 1997 from Nii Ebenezer Tetteh Annan Nettey, Head of the Sempe Mensah family. The acquisition was evidenced by a duly executed and registered indenture. The Defendants claimed ownership of the same land and allegedly prevented the Plaintiff from accessing it to develop, prompting the Plaintiff to file suit for declaration of title, recovery of possession, and injunction.
read moreJUDGMENT [1] The Plaintiff commenced the instant action by filing a Writ of Summons and Statement of Claim against the Defendants on 9th January 2025. [2] The Plaintiff is seeking for the following reliefs against the Defendants: i. A declaration of title to all that "area of 1.51 acres approximately more or less and bounded on the North West by Proposed Road measuring 50 feet and 160 feet respectively more or less on the North by Proposed Road Junction measuring 40 feet more or less on the South by Proposed Lane measuring 200 feet more or less and on the East by Proposed Road measuring 330 feet more or less and on the West by Proposed Road measuring 330 feet more or less. ii. Recovery of possession. iii. An order of perpetual injunction to restrain the four Defendants each of them and severally from going unto the land. iv. Cost and legal fees.
