ISAAC AGYEMANG vs. SMEC INTERNATIONAL PTY LIMITED

RULING Introduction The Complainant filed a case of unfair termination of contract of employment against his employer, SMEC International Pty Limited on 14th October, 2019. The matter went through facilitation and attempt to settle failed and so both parties opted for summary settlement before the Commission. After a preliminary hearing of the case, parties were directed by the Commission to file their final written submissions which they complied with and case referred for judgment conference, hence this ruling. Complainant's case: The Complainant submitted that: 1. He was employed as Project Controller - Quality Control (QC) and Quality Assurance (QA) Specialist at SMEC international Pty Ltd with effect from 27th May, 2019. 2. He worked for three (3) months without any unfavorable performance review or any irreconcilable agreement with any of his supervisors or colleagues. 3.
