Twelve days thereafter (that is, 22 January 1973) at about 8.30 a.m. a statement of claim was filed on behalf of the plaintiff and round about 4 p.m. on that same day an application was filed on behalf of the defendant praying for an order that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">“[T]he writ of summons filed by Ebusuapanyin J. B. I am advised and verily believe it to be so that by section 1 of the Administration of Estates Act ‘1961 (Act 63), until an executor is appointed, the property of my late husband is vested in the Chief Justice of Ghana. (5) That I am therefore not the party to be sued for the declaration endorsed on the writ.
