background-clip: initial;"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">This is an appeal from the judgment of the Court of Appeal (delivered on 12 August 1985: see Amua-Sekyi v Sasu [1984-86] 2 GLR 479, CA in which that court overturned the judgment of the High Court and entered judgment for the plaintiffs for the reliefs claimed on their writ of summons.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom: 5pt; line-height: 115%; font-family: "Book Antiqua", serif;">The facts of this case are simple indeed and should have presented no difficulty especially as the law applicable is one of basic principles of customary land law. Unfortunately there appears to be some divergence between the plan attached to the plaintiffs’ and their vendor’s conveyance and the physical position of the land:<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom: 5pt; text-align: justify; line-height: 115%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Briefly the facts are that on or about October 1959 Nii Ayiku II, Akumajay Mantse, conveyed a piece of Akumajay stool land to Hutton George Addy, a subject of the stool. Apparently, Addy paid the usual customary fee and was given a receipt dated 24 October 1959. There appears to be no formal conveyance executed to him but he managed to stamp whatever document he had in the Lands Registry, which document must have had a plan attached to it.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom: 5pt; text-align: justify; line-height: 115%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"> <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom: 5pt; text-align: justify; line-height: 115%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span lang="EN-US" style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">That plan was plotted and stamped as AC 6790/59. The significance of the stamped document was that it told a tale. For George Hutton Addy the evidence was that sometime in 1966 there was a fire in his house and amongst his properties lost by fire was the receipt stamped 6790/59. He accordingly approached Nii Abossey Okai II, Acting Akumajay Mantse, who gave him a confirmatory deed of the 1959 customary conveyance. This deed was registered as No 1490/77.
