The other executor so-named is one Samuel Francis Acquah (alias Yaw Mbroh), a cousin to the present applicant. All efforts made by the applicant and other members of the family to get the said Samuel Francis Acquah to join in the application for probate has not proved successful. It is the prayer of the applicant therefore that he be granted probate of the will in order to administer the estate, the court reserving the power to grant probate to the co-executor, Samuel Francis Acquah, whenever he shall duly apply for same.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In his accompanying affidavit, the applicant says that there is an urgent need for the grant of probate to administer the estate, especially with regard to the testator’s current account which is being whittled away by bank charges. In Tristram and Cootes Probate Practice (21st ed.) it is stated at 115 under the head “Power Reserved” that if there be several executors, one or more may prove the will without notice to the other or others, power being reserved by the court to grant probate to the latter whenever they or any of them shall duly apply for the same.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In view of the reference above-quoted, the court hereby orders that probate of the will of Moses Birch Walton be granted to the present applicant, Dr. Kofi Walton as prayed.
