the Circuit Court, Tamale charged with three counts of stealing under section
124 (1) of the Criminal Code, 1960 (Act 29). The brief facts of the case were
as follows: One Alhassan Alhassan complained to the police he had lost seven
cows. In the course of police investigations these cows were traced to a named
village. And the fellow in whose possession the cows were found named one
Abdulai Seidu, the second prosecution witness, as the person who owned them.
Abdulai Seidu also mentioned the appellant as the fellow from whom he had
purchased them. This led to the arrest of the appellant who also named one
Salifu Zanwara as the owner of same, although the appellant admitted he sold
the cows to Abdulai Seidu.</span><span style="font-size: 13.5pt; line-height: 115%; font-family: Helvetica, sans-serif;"><o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom: 5pt; text-align: justify; line-height: 115%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"><span style="font-size: 12pt; line-height: 115%; font-family: &quot;Book Antiqua&quot;, serif;">He was charged with the offence of
stealing on three counts as the cows were allegedly owned by three other named
persons, excluding the original complainant. Three ailing cows among the seven
were sold and ¢72,000 realised. The appellant pleaded not guilty, and after a
trial a verdict of guilty was entered against him after the court had admitted
in a mini trial, and relied upon, a confession statement the appellant was said
to have made to the police. He was sentenced to a three-year jail term without
the option of a fine. The court also made a restitution order in respect of the
¢72,000 in favour of those it held were the cattle owners, and ordered the

and order that the appellant has appealed to this court. The grounds of appeal
