House No. D 40, West Patasi Estate, Kumasi was acquired by the defendant, Kwaku Wih, in February 1974 from the State Housing Corporation on a hire-purchase lease. By the conditions of the hire-purchase the selling price of the house was ¢6,700 and the defendant was required to pay a deposit of ¢1,200 towards the selling price. The balance of ¢5,500 was spread over a period of twenty years and payable at the monthly instalment of ¢44.51 inclusive of insurance charge of ¢1.23. The defendant complied with those conditions.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Now on 1 June 1975 the defendant (as the vendor ) entered into an agreement with the plaintiff (as the purchaser) whereby he purported to assign his interest in the said house to the plaintiff. The terms of the said agreement would repay full quotation hereunder:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">“1. That the vendor has agreed to assign to the purchaser all his interest in the said house for the sum of ¢2,258 (two thousand two hundred and fifty-eight cedis). <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">2. That the vendor shall give immediate possession and quiet enjoyment of the said premises to the purchaser. 5. That the vendor shall surrender all documents on the said premises in his possession to the purchaser including (a) allocation paper No. KU/254/17 dated 1 February 1974; (b) hire-purchase condition dated 23 February 1974; (c) letter No. KU/254/13 dated 18 January 1974; and (d) letter No. KU/254 dated 26 February 1974 and all other documents that may in future come into possession of the vendor. <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">6. That the purchaser will at all times from the date hereof duly pay the remaining balance on the said house rents, rates becoming due under the hire-purchase agreement or lease and observe and perform covenants contained therein on the part of the vendor to be performed and observed. 7. That the purchaser shall keep all receipts of payments made in respect of the said premises to the State Housing Corporation and other bodies. 8. That the purchaser will at all times from the date hereof keep indemnified the vendor and his estate and effects from and against all proceedings, cost and claims and expenses on accounts of any commission to pay the said rent arrears or balance of any breach of any of the covenants in the hire-purchase agreement or the lease. 9. That if the vendor refused to make the formal deed of assignment to the purchaser after the vendor has obtained the requisite consent of the State Housing Corporation, the purchaser has the right to take legal action against the vendor for specific performance or the current value of a similar house.”<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">On 15 September 1976 (while the above contract was still subsisting) Kwaku Wih (the defendant) purported to assign his self-same interest in the house to Asonaba Dapaah (the co-defendant). This transaction was evidenced by a document which was titled <i>“UNDERTAKFNG” and ran as follows:<o:p></o:p></i></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">“THIS CERTIFIES that, I Richard Kwaku Wih of house No. D75, Effiduase-Dadiese-Ashanti, have this 15 September 1976, received from Mr Asonaba Dapaah of P. O. Box 8, Bolgatanga, and of H/No. A4 Bolgatanga, Upper Region, cash the sum of ¢10,500 (Ten thousand, five hundred Cedis) being the purchase price of house No. D40, West Patasi, Kumasi, which I have this day sold to him.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bot
