(2) A party who is not appealing from a judgment or order may apply for a review of the judgment notwithstanding the pendency of an appeal by some other party except where the ground of such appeal is common to the applicant and the appellant, or when, being respondent, he can present to the Appeal Court the case on which he applies for the review.”<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">On the evidence, I found that the termination of the plaintiff’s appointment with the defendant-judgment creditor-respondents, (herein referred to as the defendants) was unjustified. I therefore gave judgment for the plaintiff and proceeded to award him damages in the following manner:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">“All the salary the plaintiff would have been entitled to from January 1983 to January 1985 plus all allowances which the plaintiff would have been entitled to had his appointment not been unjustifiably terminated.”<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The period for assessment of the damages, namely January 1983 to January 1985, had been fixed on the assumption that the plaintiff as at January 1985 by exhibit P had been notified properly of the termination of his appointment. In the judgment, I had stated, “. . . So until exhibit P was sent to the plaintiff, he was entitled to assume that he had been dismissed summarily . . . “ This is the issue which the plaintiff has asked me to review. Counsel for the plaintiff has submitted that this statement by the court had been made under the mistaken belief that the document had been in the possession of the plaintiff and that he did actually receive the letter. Counsel for the defendant does not deny that this letter was, until it was tendered in court, in the possession of the defendant and that it was tendered by the plaintiff through the defendant’s representative who testified.
