Before putting up the said house the decedent had acquired the land on which the building stands in the name of one Michael Asante (see exhibit 3). He had also used the said land as a collateral to obtain a loan from the Barclays Bank (Ghana) Ltd. (see exhibit 4). These two exhibits were later to be deposited by him with the Social Security Bank, following a loan which he had contracted from the said bank through its branch at Koforidua. Before he died, however, the decedent made provision for the distribution of his assets by means of a testamentary disposition (see exhibit B). In the said disposition he devised house No. V. 139 to his wives, the first plaintiff herein, and the first defendant witness and their children in common. It appears that this last act of his as well as the prior acts evidenced by exhibits 3 and 4 have provoked the issue of the writ of summons herein.

<span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The defendant upon service of the writ of summons on him entered a defence in which he counterclaimed as follows:

<span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">(a)<span style="font-style: normal; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">“Declaration of title to house No. V. 139, Koforidua.
<p class="MsoNormalCxSp
