There is also the equally important principle that the applicant must demonstrate to the court that the appeal has a chance of success.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"> In this case, there is no dispute that on the 21st June, 1994 the plaintiff/judgment creditor obtained judgment against the defendant/judgment debtor herein for the sum of ¢10,720,031.33. That on the 29th May, 1995 a consent judgment was also entered against the defendant/judgment debtor in the sum of $12,328.77 and £6,600 respectively with costs of ¢2,500,000.00. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">On the 9th May, 1997 the Registrar attached House Number J.856/5 Mile 11, Nungua, Accra belonging to Mrs. Clocanus Mensah, Managing Director of the defendant/judgment debtor’s company.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">In a subsequent interpleader suit the claimant, the applicant herein, filed a statement of claim in which he averred that the property in dispute was sold to him by Mrs. Clocanus Mensah in 1977 with the consent and concurrence of the Nungua Traditional Council for an amount of ¢195 million. He also pleaded that the property in issue was at all material times the property of Mrs. Clocanus Mensah, the claimant’s vendor.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"> It is evident from the record before us that the claimant exhibited document marked as Exhibit 2(A) at the court below to support his claim. In Exhibit 2(A) it was stated that Mrs. Clocanus Mensah received from the claimant two cheques drawn on the Social Security Bank for a total value of ¢195 million being the agreed price for subletting the property with the building for 97 years. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">This being an interpleader action in respect of House Number J.856/5 Mile 11, Nungua, Accra, the law requires that since before the attachment the claimant/applicant was not in possession the burden is cast upon him to prove that at the time of the attachment he had already acquired title to the said property with the house on it.
