He was aggrieved because he was told by the respondent that he had opted for the Social Security Scheme while he on the other hand thought that he was a pensionable civil servant entitled to pension under the Pension Ordinance, 1951 (Cap. 30). He was convinced that as a pensionable officer he was entitled to pension under Cap.30<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Book Antiqua";mso-bidi-font-family:"Book Antiqua"">RESPONDENT'S CASE<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The respondent denied that the complainant was entitled to claim under Cap.30. It argues that the complainant was first engaged in the then Central Bureau of Statistics on non-pensionable terms as a messenger on 1st August, 1965. He was later appointed to the grade of an Enumerator on 1st August 1967 also on <u>non-pensionable</u> terms. He was subsequently promoted to Junior Statistical Assistant Grade II on 1<sup>st</sup> November 1972 (when entry into the pensionable grade had ceased).<b><u><o:p></o:p></u></b></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In view of the complainant's non-pensionable status by 30" June, 1965, he was registered under the Social Security Act (Act 279) in accordance with the Social Security Fund Regulations 1965 (L.I. 470) with registration number 05111794 with effect from August, 1965.
