The charge which was levelled against him was "Dereliction of duty resulting in various items missing from the warehouse ...".<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant (and other dismissed employees) protested against his dismissal, claiming that he did not know anything about the missing items.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant also protested against what he described as "wrong deduction of various sums of money from (our) benefits as Sale Value of Missing Stock". <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Further protest was directed "against the mode of calculation of the end of service benefits as not being in keeping with the. Colective Bargaining <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Agreement (CBA, Article 278 thereof).<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In its reaction to the complaint, the Respondent disputed the complainant's claim stating that the complainant was dismissed on grounds of serious misconduct, to wit, dereliction of duty; and that under the Conditions of Service of the company such conduct results in summary dismissal. The respondents further attached various correspondence including external Auditors report, query and response from warehouse staff, and invitation to meeting with petitioner etc.<o:p></o:p></spa
