Following the phasing out of the Ombudsman office the complaint was transmitted to this Commission under the provision of Section 28(2) which provides that:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">"any complaint pending before the Ombudsman immediately before the coming into force of this Act may be proceeded with under and shall be subject to the provisions of this Act."<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The facts of the case as disclosed by the complaint are that the complainant, as a Supervisor of Mails at the then Posts and Telecommunication Corporation, was dismissed in 1985 for stealing two German Mail bags and 21 coloured pencils (product of Singapore). The respondent reported the matter to the Police. A search party by the Police discovered two mailbags and some coloured pencils in complainant's room.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.2pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant was placed under suspension without pay and was subsequently arraigned before the Circuit Court in Sekondi together with two other employees of the Corporation on a charge of stealing.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .45pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The trial was frustrated by non-attendance of witness for the prosecution and so the complainant as an accused person was discharged by the court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.2pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">According to the complaint he was invited to appear before the Disciplinary Committee of the Corporation to answer a charge of stealing. According to them the complainant was suspected of having stolen property belonging to the Corporation and that two German mailbags were found in his house.
