line-height: 115%; font-family: "Book Antiqua", serif;">Awuni Yedogo, the complainant herein by his complaint dated 8th March 1996 claimed the following from the respondent, Forewin (Gh.) On 19 February 1996 he reported for duty as usual and got injured in the foot in the course of work. He accordingly made a report to his boss, Mr. Ahmed, the Warehouse Manager. The Manager in question told the complainant that the company had no facilities for treating him, therefore he should take off some days to treat himself. The complainant eventually reported to work on 8 March 1996. The complainant was shocked to be informed that he had been dismissed and has thus been dissplaced. The complainant asked for his letter of termination for the reasons of his dismissal but they refused to issue him one.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.65pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant said that he has not been fairly treated, thus his claim or complaint.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .45pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">On their part the respondents commended that the complainant vacated his post. Until the receipt of this complaint from this Commission the company had been under the impression that Awuni Yedogo had unceremoniously left his job.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The respondent vehemently denied that the complainant got injured in the course of work. Rather the complainant reported to work with an ailment and requested that he be allowed to go home and treat himself. He was granted the permission to go and treat himself since he did not sustain the ailment on the job but had it somewhere. He took a leave of absence verbally with his immediate supervisor and felt okay with that and went away. He spent almost two (2) weeks to treat himself and came back. He then had verbal discussions with his immediate supervisor on his return on the condition of his leg without any written warning from the company or dismissal letter from the respondent.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .45pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant 'chose and or elected and or decided voluntarily to stay out of work and then surface at the Commission to make this petition.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 2.4pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Commission initiated mediation into this matter. The respondents proposed two months salary in full settlement of the matter. The Commission made efforts to get the complainant's comments on the respondent's proposal but the complainant never responded.
