The respondents against whom the complainant had his grievance were Mohammed Wolley, Fawazi. Wolley. Bassam Kabara and Abdul L. Mikati. They are Lebanese nationals.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.9pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The controversy arose in the operation and running of the AEL. The facts narrated in the complaint of May 1999 were that the AEL received a grant of US$6.5 million under the Lome III Convention from the Western African and Caribbean Department of the European Investment Bank (EIB) for the purpose of expanding and modernizing the AEL plant; as a condition EIB officials were sent in to manage the project and supervise the disbursement. Two British consultants initially sent in could not cope with pace of the work and therefore were withdrawn and replaced with a German consultant called Wolfgang Trosch. According to the complainant Mr. Trosch totally alienated him from the operation of the company confined him to his house with a paltry salary of $600,000.00 (US$250) per month. This was at a time when Mr. Trosch allocated to himself a salary of US$12,000.00 per month and started indulging in shady financial deals in the company. In collusion with the 1st respondent, Mr. Trosch terminated the appointment of a large number of the company's key personnel who had been employed by the complainant without any benefits. The complainant further alleged that Mr. Trosch and the 1st respondent siphoned huge sums of money from the company account both in local and foreign currency that they again fraudulently inserted a figure of ¢60,000,000.00 in an indenture to appear as though the AEL had sold a plot of land to them and when he questioned the conduct of misuse of the company funds and the fraudulent acts, Mr. Trosch parked out of the company, took away stocks, material and properties of the company and left it in 'ruins'.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Because of the conduct discussed above the complainant said he sent petition to the Office of the President, the Commissioner of Police, the Director of BNI, the Director, Serious Fraud Office and the Consular German Embassy, Accra.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The complainant stated in his complaint that he made the complaint to the bodies mentioned because he intended to frustrate Mr. Trosch from leaving the country without accounting for his mismanagement of AEL. The complainant failed in that endeavour; he was rather arrested and prosecuted for the deceit of a public officer, before an Accra Community Tribunal; the conviction and sentence were later over turned by the Regional Appeal Tribunal. During these processes Mr. Trosch succeeded in fleeing the country without giving an account of his management of AEL which was drain of funds and heavily indebted to many financial institutions and companies.
