Attached to this letter was a petition by the Complainant herein to the Head of State, his Excellency the President together with certain annxures.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 2.2pt;line-height:normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The letter from the Office of the President highlighted certain considerations for redress and requested the Commission "for thorough investigations and appropriate advice". The said letter indicated that the matter was before the Court and that in the view of the complainant "out-of-court settlement is the best option".<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In its petition to the President, the complainant asked for redress as follows:-<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">i. That the Lands Commission Secretariat allocates a replacement plot of similar size in an industrial area of Accra. He requested that all charges should be waived since he had already paid all development, surveying, pillaring and other charges.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">ii. Refund of all costs incurred by him in respect of fence wall, reclamation, filling and foundations (part) works done on the land.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .7pt;line-height:normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The Commission upon the receipt of the letter from the President's Office advised the complainant that it could not investigate the complaint since it was before the Court, the Commission lacked jurisdiction to investigate.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">Eventually the Commission commenced investigation after the complainant had withdrawn its case from the Court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The parties were served with several hearing notices to enable the Commission to mount a full hearing, into the matter but it was apparent that Japan Motors would not present itself for the hearing the Commission decided to go on with the hearing of the case without them. Several notices had been served on Japan Motors as well as the Counsel for Japan Motors but to no avail.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In his evidence the Managing Director of the Complainant stated that plot No.55 A, Ring Road South Industrial Area was allocated by Lands Commission the Respondents herein by Exh "A" a leasehold dated 11th March, 1974. The same was registered as Land Registry No.1690/1974. After the allocation of the Exh "A" the complainant took possession of the land. It discovered the land to be swampy, bushy and water logged. The Complainant therefore re-claimed the land by pumping the water out of the land, filling the land with 200
