During this period, the Respondent, by a letter dated October 30, 1996 extended his probation for further 3 months to end on December 31, 1996. Meanwhile, on January 3, 1997, his doctor advised that he be put on light duties for 4 weeks, pending a review on January 31, 1997. On January 13, 1997, some 2 weeks before the review, the Respondent terminated his appointment citing his condition of health without paying him anything. He therefore came to the Commission for help to get all compensations due to him as a worker paid to him.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;tab-stops:282.0pt;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">The Respondent in its reply admitted the allegations but explained that it found Complainant's work and conduct satisfactory as at August 12, 1996, but could not confirm him since his performance began to deteriorate after that period. Hence the extension of his probation to afford him more time to recover. At the expiration of the extended probation period, the Respondent noticed that the Complainant was still unable to work. Management therefore gave him an option for an indefinite leave without pay, to enable him get completely cured before returning to his job. The Complainant however turned down the offer. After this, Management had no other choice than to refuse to confirm his appointment.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.9pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">On August 4, 1997, the Commission sent to the complainant a copy of the Respondent's above letter requesting him to react to the contents. As no reply as forthcoming a reminder was sent on February 18, 1998 followed by yet another on May 20, 1999 giving him up to June 15, 1999 to respond.
