In his petition dated 3rd November, 1997 he requested the Commission to intervene and compel the Divestiture Implementation Committee, Second Respondents herein to sell to him H/No. C.24, Kalpolin Estates, Tamale, belonging to the Ghana Publishing Corporation 1st Respondents on the grounds that he was the sitting tenant.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">Whilst the petition was being investigated by the Commission, Mr Ishak Alhassan whose bid to purchase the house in question had been accepted by the 2nd Respondent cross-petitioned as an interested party requesting the Commission to prevail on the 2nd Defendants to conclude the transaction by passing vacant possession to him. In his cross-petition Mr Ishak Alhassan further demanded that if the Commission was going to prevail on the Divestiture Implementation Committee to sell the property to the Complainant, the Commission should also prevail on the Divestiture<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">Implementation Committee to refund to him the purchase price paid by him together with interest.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .2pt;line-height:normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">Discussions were held with the 2nd Respondents as well as the Complainant in a bid to resolve the issues raised.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In a letter dated 6th September, 1999 the Complainant informed the Commission of his paymet of the amount of ¢5,365,000.00 representing the purchase price of the house to the Divestiture Implementation Committee. He indicated his willingness to pay the two years' interest on the figure which by his reckoning stood at ¢2,360,600.00 or any other figure computed for him by the Divestiture Implementation Committee.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 2.85pt;line-height:normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">By another letter dated 25th January 2000, the Complainant further informed the Commission of his payment of the amount of ¢8,342,575.00 to the Divestiture Implementation Committee representing the principal sum and the interest in accordance with the wishes of the 2nd Complainant, Mr. Ishak Alhassan. Copies of payment slips evidencing the said payments were attached for perusal.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;line-height: normal;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In the circumstances the Commission considers all issues in this matter as conclusively resolved.
