He thought that the decision was not justified and sought redress through a spate of petitions to relevant government agents including the President, and to the Police hierarchy from 1983 to 1990. Regrettably, the government did nothing to justify or prove its action. In a letter dated June 17, 1986, the PNDC Member responsible for the Ministry of the Interior informed the Complainant that "since it was the decision of the PNDC to dismiss [him]" it could not reverse such a decision". On July 22, 1996, he petitioned the Commission for redress and a declaration of his dismissal as null and void.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 2.3pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><b><u><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">THE COMPLAINANT'S CASE</span></u></b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua""><o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">According to the Complainant, the "Ghanaian Times" edition of 3rd September, 1983 attributed his dismissal to his persistent indulgence in "Kalebule". That he used the name of the Police to buy commodities such as petrol and cloth which he later sold through his agents at exorbitant prices. It also claimed that he further used Police vehicles and his office to cart loaded goods, which his agents sold at "Kalebule" prices.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The Complainant submitted that he was never tried by any court of competent jurisdiction, nor was he subjected to department enquiry as required by the Police Service Law and Regulations. The Commission requested for comments from the Government on July 25, 1996 and from the Inspector General of Police on February 28, 1997. A spate of correspondence, visits and telephone calls to elicit the necessary comments failed.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Book Antiqua";mso-bidi-font-family:"Book Antiqua"">DECISION APPRAISAL OF CASE VIS-À-VIS THAT OF J.K. OWUSU<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">It is noteworthy that the Complainant was among nine top Police Officers fired by the government as carried by the September 3, 1983 edition of the "People's Daily Graphic". One of them was Mr. J.K. Owusu, an Assistant Commissioner of Police, whose complaint was decided by the Commission in his favour on 14th February 1995, having complained to the Commission in 1993. His dismissal was predicated on corruption, namely that he had collected $525,000.00 bribe from a suspect in a gold syndicate case. In his case the IGP commented that the Special Publ
