REPORT<o:p></o:p>

</div>The
complainant in this case claimed that he worked as a machine operator for seven
years for the Respondent. He lost two fingers in the course of his employment.
On 10. April, 2000, his appointment with the Respondent Company was terminated
without any explanation.<o:p></o:p>The
Complainant lodged a complaint with the Commission claiming compensation for
the termination of his appointment and also a letter of testimony affirming
that in spite of his physical disability, his performance as a worker was not
affected.<o:p></o:p>The
Respondent, in comments on the allegations of the complainant, stated that it
was true that the complainant was an employee and had been injured in the
course of his employment. The Respondent however stated that this had nothing
to do with the termination of the complainant's appointment.<o:p></o:p>In
the same letter addressed to the Commission, the Respondent attached copies of
documents evidencing that the complainant was duly paid all his entitlement,
The complainant was also compensated on the direction of the Labour Department
following his loss of two fingers. All these documents portrayed the signatures
of the complainant evidencing receipt of monies paid to him.<o:p></o:p>The
Commission invited the complainant for a discussion on the 29th June, 2000 when
he conceded that the Respondent paid him ¢3,870,336.42 on the termination of
his appointment. He also affirmed that he was compensated when he lost his two
fingers.<o:p></o:p>He
was however unhappy at the refusal of the Respondent to give him a letter
testifying that his performance was not affected by the loss of his two fingers
as this may serve as a disincentive in his bid to get a new job. He pleaded
with the Commission to impress upon the Respondent to give him the letter of
recommendation.<o:p></o:p>When
invited for discussions, the Respondent readily agreed to give the complainant
an open letter certifying that he had worked for the Respondent and also that
he was competent in spite of the loss of his two fingers.<o:p></o:p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent:

this matter has been settled amicably, the Commission ceases further
investigations into the case in accordance with S.13(1)(b) of the Commission on
