mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">On the 31st of December 1989, Dr. Yiadom Atta Konadu and Anthony Peprah who are both former Directors of the Ministry of Food and Agriculture, were interdicted by the then PNDC Government. They were investigated by the National Investigation Committee for a couple of years but no adverse findings were made against them. However in February 1992, the petitioners were retired prematurely from the civil service without any reason being assigned.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;mso-pagination:none;border:none; mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><b><u><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Book Antiqua";mso-bidi-font-family:"Book Antiqua"">COMPLAINANT'S CASE<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.4pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">By a letter dated 23rd November 1995, Dr. Yiadom Atta Konadu complained to this Commission about his premature retirement as well as that of Mr. Anthony Peprah. According to him no reasons were assigned for their interdiction in 1989 and again no reason was assigned for the decision to retire them prematurely from the Civil Service. It was further stated that their interdiction was widely publicized, thus embarrassing and compromising their positions as Traditional Rulers. Furthermore all other officers who were interdicted alongside Dr. Yiadom Atta Konadu and Mr. Anthony Peprah have been recalled. The petition therefore sought the assistance of the Commission for the reversal of the premature retirement of Dr. Atta Konadu and Mr. A. Peprah.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;mso-pagination:none;border:none; mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><b><u><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-fareast-font-family: "Book Antiqua";mso-bidi-font-family:"Book Antiqua"">RESPONDENT'S COMMENTS<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The respondent, Ministry of Food and Agriculture, in it's comments on the petition confirmed that Dr. Atta Konadu had been interdicted without reason and subsequently retired prematurely at the age of 57, with effect from February 1992<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .7pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">The respondent further proposed that Dr. Atta Konadu be considered for full payment of salary arrears and other benefits from February 1992 to the date on which he would have compulsorily retired and that his pensionable emoluments should accordingly be adjusted to take effect from August 1995.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 1.9pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">Several letters sent to Dr. Atta Konadu asking for his reaction to the respondent's comments and to ascertain whether the respondent's proposal had been implemented, went unanswered.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">On the 30th October, 1998 the Commission ceased investigation on grounds of abandonment by the petitioner.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In October 1999, the Commission received a letter dated 8th October 1999 from the Office of the Head of Civil Service requesting the Commission to give a specific ruling in the matter of Dr. Atta Konadu and Mr. Anthony Peprah.
