</div>On
14th September, 1999 the Complainant E. A. OKYNE filed his complaint with the
Registry of this commission complaining against the Respondents herein to
intervene against his demotion and suspension contrary to the policy operation
at CEPS.<o:p></o:p>According
to the Complainant the action taken by CEPS is a travesty of justice and is
inimical to his progress in CEPS.<o:p></o:p>The thrust of the Complainant's case is
that he travelled to Accra for official assignment in between February and
March. On his return a report was made to him that there was a short collection
of duty on certain goods arrested. Upon a report submitted by the Public
Relations Officer whom the Complainant instructed to investigate the case, the<o:p></o:p>Complainant
queried his 2nd in command on 23rd&nbsp; March 1999. No response was received from his
2nd in command.<o:p></o:p>The Complainant reported the matter to the
Headquarters of CEPS. On 9th September, 1999 the Complainant rather was demoted
and suspended from duty with loss of pay for 6 months,<o:p></o:p>Upon the receipt of the Demotion and
Suspension memo, dated9th September, 1999 and signed by Assistant Commissioner
(Adm.) the Complainant filed this complaint. The Commission promptly took
action by requesting the Respondents to forward their comments to the
Commission. Instead of commenting on the complaint as requested by the
Commission, the Complainant was interdicted.<o:p></o:p>The Commission was naturally embarrassed
since this action by the Respondents amounted to contempt of the Commission. The
Commission therefore by virtue of a letter dated 11th November, 1999 restrained
the Respondents from any further action pending the completion of the
investigations embarked upon by the Commission.<o:p></o:p>Later
a delegation from the Commission comprising of the Deputy Commissioner
(Legal/Operations, and Legal Officer met the Commissioner CEPS and other high
ranking officials of the Respondents with the primary aim of settling this case
amicably.<o:p></o:p>During
the said meeting, after a lengthy discussion, the Commissioner CEPS stated that
if the Complainant would write a letter of apology to him, the Complainant
would re-instated. The Complainant was duly informed of the request by the
Commissioner CEPS, which the Complainant accordingly complied with by a letter
dated 12th June, 2000. .<o:p></o:p>It
is regretable to state that the Commissioner CEPS did not fulfil his promise of
