He was therefore summarily dismissed in accordance with clause 8.3 of the Collective Bargaining Agreement (CBA). Since the Complainant admitted that he took away cut off roofing materials without permission in the absence of any other explanation from the Complainant, his action amounts to the misconduct of "stealing" as provided in the CBA. His plea for reinstatement or benefits cannot obviously be considered. The Commission therefore finds the complaint unmeritorious and dismisses same accordingly.<o:p></o:p></span></p><p>
