Noble Mensah is tightly woven to that of Mr. D.K. Osei which was decided on the 14th October 1996 by this Commission. In that case, the Commission found in favour of D.K. Osei and ordered his reinstatement without loss of seniority; all accrued salaries and allowances from the time of his purported dismissal were to be paid to him.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"; color:#121200">The facts of D.K. Osei's case were that he was an accountant with the GES attached to the K.T.I. In February 1991 he was removed from office by radio announcement, a letter was subsequently sent to him by the GES to confirm his removal. He challeged his removal from office and called for the reas for the action taken against him. He alleged that he was aware of investigations conducted nationwide in the GES, but no adverse finding was made against him.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;tab-stops:2.75in;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Like D.K. Osei, this Complainant Noble Mensah before his dismissal was an employee of the Ghana Education Service (GES), teaching at the Kumasi<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .95pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Technical Institute (K.T.I) as a Course officer and Head of the Electrical Department. He stated in his complaint that on the 15 February 1991 he heard a radio Broadcast that he had been removed from office. His salary was immediately cut off.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .95pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua";color:#131300">Later, on 2nd October 1991, the Director-General of the GES addressed a letter to him confirming his removal but effective from 1st July 1989 and</span><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"> </span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"; color:#131300">this letter was said to be a confirmation of the contents of a press release made on 15th February 1991.</span><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">When the GES was requested to comment on the complaint, it stated that it received instructions from the Castle to remove the Complainant from office and it obeyed the orders. Earlier on, the K.T.I had written in answer to the Commission's quest for comments and stated that it followed the dictates of a press release that certain officers including the </span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"; color:#333300">Complainant must be removed from office.</span><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;"><o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">As discussed in the Commission's decision in respect of D.K. Osei, all the efforts by the Commission to procure comments to throw light on the reasons for the removal of the Complainant proved futile; the Office of the President on whlch the Commission relled for information could not be of any help. After diligent investigative processes, it became clear that it would be extremely unlikely for any reports on the matter to be procured because the alleged investigation
