The court was therefore compelled to hear plaintiffs’ case in defendant’s absence to determine the question of title and damages. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Plaintiffs testified through the 2nd plaintiff, Martin Oduro and tendered in evidence six documents to support their case. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">After hearing from plaintiffs, the court came to understand the reasons behind defendant’s elusive behaviour. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The fact is that the court is convinced by plaintiffs' unchallenged testimony that they (pfs.) are entitled to all the reliefs being claimed. The court therefore has no alternative than to enter judgment in plaintiffs' favour on the remaining reliefs, viz; ‘a’, ‘b’ and ‘d’, as endorsed on the writ of summons. <o:p></o:p></span></p><p> </p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Plaintiffs are awarded general damages of ¢6 million with costs of ¢4 million.<o:p></o:p></span></p></span>
