In their writ of summons before the High Court, the/ plaintiffs claimed against the defendants:<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">"(i) a declaration of title to all that piece of parcel of land situate lying and being at Kplagon Ofankor along the Accra-Nsawam Road covering approximately an area of 14.28 acres and more particularly described in the statement of claim; and<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">(ii) an order for cancellation, revocation and nullification of the deed of conveyance made between Rudolf Agbesi Fenuku of the one part and Lawrence John Teye of the other part dated I0 April 1974 and registered at the Deeds Registry as No 1888/ 1974."<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The High Court gave judgment for the plaintiffs but the Court of Appeal, on appeal by the defendants, set aside the decision and dismissed the plaintiffs' claim. The plaintiffs have appealed against the decision of the Court of Appeal to this court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The facts of the case are that in 1954 one Rudolf Agbesi Fenuku (now deceased) and his wife, Mrs Mercy Fenuku (also deceased) acquired a large tract of land measuring approximately 17.83 acres at Kplagon Ofankor on the Accra-Nsawam Road in their joint names from the Odompoiawe of Asere Quarters, Accra. The transaction was evidenced in writing which was tendered in evidence in these proceedings as exhibit B; it is dated 27 May 1954. Mrs Mercy Fenuku died in 1958. After her death, Mr Rudolf Fenuku married one Miss Victoria Teye who became Mrs Victoria Fenuku; that was in 1969. Mrs Victoria Fenuku was the sister of Lawrence John Teye, proprietor of the Reverend John Teye Memorial Institute. Lawrence John Teye in the same year of his sister's marriage to Rudolf Agbesi Fenuku, moved the institute to the land of the Fenukus. In 1974, Mr Fenuku sold the land to Lawrence John Teye, reserving a portion of the land to his son Rudolf David Fenuku as a gift.
