This move was approved by the parties who were directed to file their instructions to the surveyor. In time, it became necessary for the parties to go to the land in dispute with the surveyor and physically assist him to make a survey. Only the respondent went to the land in dispute and assisted the surveyor who thereafter made a survey plan which he tendered in evidence in court. At the end of the trial, the court entered judgment in favour of the respondent. Aggrieved by this judgment, the appellants appealed to the High Court, Accra and on 14 August 1990 the High Court per Ammah J affirmed the decision of the trial district court and dismissed the appeal.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">It is against the High Court’s decision that the present appeal has been lodged.
