mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua""> JA delivered the judgment of the court at the invitation of Lartey JA. The appellant was arraigned before the High Court (Fast Track) on 9 October 2002 on three counts of wilfully causing financial loss to the State, contrary to section 179A (3)(a) of the Criminal Code, 1960 (Act 29), and a fourth count of intentionally misapplying public property, contrary to section 1(2) of the Public Property Protection Decree, 1977 (SMCD 140). He pleaded not guilty to the charges, and at the end of the case for the prosecution his counsel made a submission of no case to answer, to which counsel for the Republic replied and on 28 March 2003 the trial High Court overruled the submission of no case to answer and accordingly called upon the appellant to enter into his defence.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">It is from this ruling that the appellant has appealed to this court on the following eighteen grounds of appeal:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">“(i) the trial judge erred in law in overruling the submission of no case made by counsel for the accused without providing reasons why this was legally proper; <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">(ii) the trial judge erred in law in believing that she did not have to give reasons for her ruling; <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">(iii) the trial judge erred in law in disregarding pertinent legal and constitutional issues raised before her and coming to her conclusion without a judicial consideration of those issues; <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">(iv) the trial judge erred in law in disregarding both binding and persuasive precedents on the responsibility of the judge upon submission of no case; <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">(v) the trial judge erred in law in respect of the first three counts in not realising that on the evidence adduced by the prosecution, the payments alleged to have been authorised and caused to be made by the accused were not made on the authority or instruction of the accused; <o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;mso-pagination:none;border:none;mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">(vi) the trial judge erred in law in respect of the first three counts in ignoring her re
