font-family:"Book Antiqua","serif"">The appellant alleges that he was induced to make certain agreements, documents and Indentures with the respondents by economic duress after he had entered into negotiation with the respondents to become business associates.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> Thereafter the respondents submitted to the Chief Registrar of Lands one of the Indentures for registration of title.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> When the appellant got to know of this he instructed his solicitor to write to the Chief Registrar of Lands to caveat the intended registration. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">The Respondents then sued the appellant in the High Court claiming the following reliefs.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> “(a) The sum of US Dollars 175,648.00 being money the defendant (appellant) owed the plaintiffs (respondents). <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif"">(b) Interest on the said sum at 10% per anum from 1st November, 2000 to the date of final payment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> (c) Costs.”<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> The appellant entered an appearance to the claim and filed a Statement of Defence and counter claim which he later amended.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> The counter claim reads:<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; margin-left:.5in;margin-bottom:.0001pt;text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua","serif""> “(1) A Declaration that the Defendant (appellant) was included to make or enter into the agreement or instruments or indentures referred to or alleged in the counter claim by duress on the part of the Plaintiffs (respondents).<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:0in; font-family:"Book Antiqua","serif"">Subsequently the appellant filed a motion of notice for an order of interlocutory Injunction to restrain the respondents, their assigns, the Chief Registrar at the Land Title Registry from processing the respondents/application for a Land Title Certificate in respect of the Deed of Assignment made between the appellant and the respondents. The respondents filed an affidavit in opposition to the application for Interlocutory injuncti
