</div>This
complaint concerned the salary arrears of the Complainant. It was lodged with
the Commission on 25th September 2002.<o:p></o:p><o:p>&nbsp;</o:p>THE COMPLAINANT'S CASE:<o:p></o:p>The Complainant was a Sales Assistant of
the Respondent. He was employed on 5th September 2001. His post was the Arena
outlet of the Respondent in Accra.<o:p></o:p>His claim was that he had been wrongfully
accused of selling eggs to the Respondent's customers at unapproved prices and
pocketed the difference. Consequently, he was summarily dismissed on 29th
August 2002.<o:p></o:p>According to him, the accusation and
subsequent dismissal followed his plea to the Respondent to pay his July 2002
salary because that salary had unduly delayed. He further stated that he was
not given a hearing to enable him defend himself with regards to the
allegations and that the Respondent never paid his social security
contributions.<o:p></o:p>His request was for the Respondent to pay
his July and August 2002 salaries, one-month salary in lieu of notice and
social security contributions.<o:p></o:p>THE RESPONDENT'S CASE:<o:p></o:p>When contacted on 4th December 2002, the
Respondent indicated that the Complainant sold some eggs above the correct
prices and pocketed the difference. Resultantly, he was dismissed and informed
that he would forfeit his salaries for July and August 2002.<o:p></o:p><o:p>&nbsp;</o:p>THE COMMISSION'S
OBSERVATIONS/DECISION: <o:p></o:p>The
Complainant's dismissal letter (dated 28th August 2002) indicated that he was
dismissed because of his illicit operations at the Arena Outlet where it was
established that he sold eggs at unapproved prices and deceitfully pocketed the
