By its counterclaim as amended on 11-3-2004, the defendant is seeking the following reliefs: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The sum of ¢60,405,000.00 being the losses which the Defendant incurred as a result of the Negligence of the servants and or agents of the Plaintiff. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(ii) Interest on the said sum at the prevailing bank rate from 26th May 2002 to the date of final payment. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(iii) The sum of US $36,000,.00 and ¢12,000.00 being the contents of the steel safe. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">(iv) An order of the Court for the Defendant to retain possession of the offices premises until (ii) and (iii) above are settled by the Plaintiff. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">In her Reply and Defence to Counterclaim, plaintiff denied all the allegations of negligence and denied that there was US $36,000.00 kept in the disputed premises. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Having admitted the claims of the plaintiff, as contained in paragraphs 2-7 of the Statement of Claim, but contending that the plaintiff was liable to it in negligence for the losses it had sustained from an alleged robbery, the following issues were settled for trial at the close of pleadings: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">a) Whether upon the admissions by the defendant of the facts pleaded in paragraphs 2, 3, 4, 5, 6, & 7 of the Statement of Claim, the defendant is entitled to retain possession of the premises without paying the rent on the basis of defendant's Counterclaim. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">b) Whether the plaintiff is liable to the defendant in negligence. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">c) Whether having identified the perpetrator of the alleged stealing against the defendant, the defendant can hold the plaintiff liable. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">d) Whether the defendant incurred losses of ¢60,405,000 as a result of the negligence of the plaintiffs servants/agents. <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify;text-indent:2.25pt; line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua","serif"">e) Whether the plaintiff is entitled to the reliefs sought.
