The property was sold by the 3rd Defendant, a licensed auctioneer, and purportedly purchased by the Co-Defendant, Richard Cofie. 4th and 5th Defendants were the Court bailiffs who carried out the instructions of the Deputy Sheriff, and 6th Defendant is in residence at the property in dispute, apparently as the tenant of the Co-Defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">The case of Plaintiffs is that the Co-Plaintiff, Joseph Kwaku Thompson was the owner of the house, the subject matter of dispute. In his evidence-in-chief on 4th May, 2004, Co-Plaintiff said he gave the title deeds of the property and a Power of Attorney to 2nd Defendant, Grace Ankomah to enable her obtain a loan for her business. He thereafter left the jurisdiction between 6th November, 1991 and 27th November, 1999 during which period his son, Plaintiff herein lived in the house and was in charge of the house. During this period, 2nd Defendant took a loan from the 1st Defendant and defaulted. 1st Defendant took action at the Tema High Court to recover the loan and attached the property, which was eventually sold by public auction. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"">Co-Plaintiff testified that the title deeds to the house and the Power of Attorney were given to 2nd Defendant to obtain a loan from the commercial bank. That however, contrary to the terms of the Power of Attorney, 2nd Defendant had taken a loan from the 1st Defendant.
