mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua""> On 25 May 2005 the High Court, Kumasi presided over by Ansu-Gyeabour J dismissed the preliminary objections raised by the respondent-appellant (hereinafter referred to as the respondent) and the interested party-appellant (hereinafter referred to as the interested party) against an application for an order of mandamus filed by the appellant-respondent (hereinafter referred to as the applicant). Aggrieved by the ruling of the trial High Court, the respondent and the interested party have appealed to this court.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">What are the facts giving rise to the application for mandamus? They are as follows: The applicant was on 24 June 1994 enstooled as the Omanhene of Wassa Fiase Traditional Area. On 24 November 1994 his name was duly entered in the national register of chiefs and thereafter he was gazetted by notice published in the Local Government Bulletin, No 16 of 27 December 1996. The nomination and enstoolment of the applicant was challenged in the Western Regional House of Chiefs which subsequently granted an order of interim injunction restraining the applicant from holding himself out in any manner whatsoever as.the Omanhene and president of the Wassa Fiase Traditional Council. It is alleged that in spite of the said interim injunction order of 1994, the applicant continued to act as Omanhene and on 19 April 2002 the High Court presided over by Senyo Dzamefe J, convicted him of contempt and sentenced him to fourteen days’ imprisonment without the option of a fine.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">In the absence of the applicant in prison, the interested party was nominated, elected and installed as the Omanhene of the Wassa Fiase Traditional Area on the basis, it is further alleged, that with the conviction and sentence of the applicant for contempt, the Wassa Fiase paramount stool had fallen vacant. The name of the applicant was allegedly deleted from the national register of chiefs and the name of the interested party therein recorded, a procedure which the applicant describes as contrary to the normal.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">The Court of Appeal (differently constituted) on 17 July 2003 set aside the conviction and sentence imposed on the applicant for contempt. The applicant, thereafter, invited the respondent to react to the appeal judgment by restoring or reinstating the name of the applicant to the national register of chiefs and to delete therefrom the name of the interested party. The applicant contends that it is the failure or unexpressed refusal of the respondent to have his name reinstated in the national register of chiefs that has precipitated this application for mandamus.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">Arguing the preliminary objections in the High Court, counsel for there spondent relied basically on three main grounds, namely:<o:p></o:p></span></p><p class="MsoNormalCxSpMiddle" style="margin-left:.5in;mso-add-space:auto; text-align:justify;text-indent:-.25in;mso-pagination:none;mso-list:l0 level1 lfo1; border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:
